Evansville police release name of man shot by officers

Sep 08, 2023

EVANSVILLE — Police have identified the man shot by two Evansville officers Tuesday afternoon as 35-year-old Kody Schaum – and he has been preliminarily charged with attempted murder.

In a news release sent Wednesday, EPD stated Schaum is alive, but continues to undergo medical treatment. He underwent surgery on Tuesday, spokeswoman Sgt. Anna Gray said.

When he is medically released, Schaum will face charges of attempted murder, resisting law enforcement and possession of a handgun by a serious violent felon, according to an EPD release. He will also face charges on his felony failure to appear warrant, which police claim led to the altercation with Schaum Tuesday afternoon.

Dash camera footage shows Schaum appear to rack the slide on a handgun.

According to Gray, two EPD officers were driving, in separate vehicles, in the 1500 block of East Indiana Street when they recognized Schaum and realized he had a local warrant for his arrest. The warrant was for a failure to appear on felony charges of possession of meth, possession of a syringe, possession of marijuana, criminal mischief and disorderly conduct.

Body cam footage provided by EPD at a Tuesday evening news conference shows an officer drive up East Indiana Street directly toward a parked SUV with its trunk open and two men standing outside it.

The officer tells the man, now known to be Schaum, to raise his hands come toward him. When Schaum doesn't, the officer uses his radio and says, "we've got one at gunpoint. He's not showing us his hands."

Two seconds later, more than 10 shots are fired by police.

"(The man) removed his right hand from the vehicle and was holding a handgun," Gray said. "He raised the firearm and racked the slide."

Dashcam footage shows the man with a gun in his hand as officers shoot him. He falls to the ground, with what police say was a .9 mm handgun as officers continue to tell him to raise his hands.

The Courier & Press has requested radio calls and the run card on the incident from Central Dispatch and has not received a response.
